ACCEPTANCE OF TERMS

Mitwa.ai (“Mitwa”, “we”, “us” or “our”) is committed to protecting your privacy. This PrivacyPolicy explains how we collect, use, store, and protect your personal information when you usethe Mitwa.ai mobile application (the “App”). By using the App, you agree to the practicesdescribed in this Policy.

1. Personal Data We Collect

We operate a mobile-only, offline app, and we minimize data collection. The personal information we collect and process is limited to:
● Account Information: When you register for Mitwa.ai, we collect the information you provide during sign-up. This may include your email address or a third-party login identifier (if you choose to log in via Google or Apple). We do not collect any account passwords for third-party logins; those authentications are handled by the provider (e.g., Google/Apple/ Firebase).
● Purchase Status: Mitwa.ai offers a paid purchase plan through the Apple App Store. All purchases are processed by the respective app store platforms. We may receive limited purchase information to unlock or restore purchase access.
● Apple’s Data Practices: When you use the App via the Apple App Store, certain device or purchase-related data may be collected by Apple under its own privacy and analytics policies. Mitwa.ai does not control Apple’s analytics systems but relies on Apple to follow its published privacy commitments and industry-standard security practices.
● Basic Device Information: We do not collect your GPS location, contacts, photos, or other device data. If any device permission is needed for a feature (for example, microphone access), the app will request it at the time of use, and you can choose whether to allow it.
● Customer Support Communications: If you contact us for support or submit a privacy request, we will collect the information you choose to provide (e.g., your contact email and the details of your request) to assist you.
Mitwa.ai does not collect any health or wellness data you may input into the app. Any personal reflections, entries, or conversation content with the AI model are processed locally on your device and never sent to us or any third-party server. We have no access to your entries or conversations, ensuring your privacy and confidentiality.

2. How We Use Your Information

We use the limited personal data we collect strictly for the following purposes:
● Providing and Improving the Service: We use your Account Information to create andmaintain your account, authenticate your login, and allow you to use the App’s features.For example, your email or third-party ID lets you securely sign in and access yourpersonal AI companion. We may also use your account or device info to provide appupdates, troubleshoot issues, or improve compatibility.
● Purchase Management: We use limited purchase status information provided by Appleto unlock premium features and help restore purchases on your device. We do not processor store payment card details.
● Account Communications: We do not send marketing communications. We may sendessential service-related messages such as account or support updates and legal notices.We will not contact you for promotional purposes, and we do not send push notifications.
● Customer Support: If you reach out to us, we will use your contact information and thedetails you provide to respond to your questions, troubleshoot problems, and help resolveany issues. We only use this information to assist you and improve the service based onfeedback.
● Legal Compliance and Security: In rare cases, we may process or disclose personal dataas required to comply with applicable laws, regulations, legal processes, or enforceablegovernmental requests. For example, we may need to retain certain information tocomply with tax laws or to respond to a lawful court order. We may also process data asnecessary to investigate or address fraud or security issues.
● No Advertising or Profiling: We do not use your data for targeted advertising, profiling,or marketing research. Because we don’t collect usage analytics or conversation content,we do not profile you or make any automated decisions about you that have legal orsignificant effects. Your personal data is not sold or shared for marketing purposes.

3. Legal Bases for Data Processing

● The primary legal basis for processing your personal data is your explicit, informed, andaffirmative consent. By creating an account and interacting with the Bloom AI model,you provide your clear consent for Mitwa.ai to collect, store, and process this informationto provide the Service.
● We may process personal data without seeking consent only under specific LegitimateInterest as defined by applicable law. This includes:
○ Security and Fraud Prevention: Processing necessary to detect, prevent, or addressunauthorised use of the Service, cyber-attacks, or fraudulent transactions.
○ Legal and Regulatory Compliance: Processing required to comply with any orderor rule made under Indian law (such as financial record-keeping) or to respond toa valid legal request from a judicial or quasi-judicial body.
○ System Integrity: Minimal processing required to ensure the operational stabilityand performance of the Service, provided such interests are not overridden byyour fundamental privacy rights.

4. Data Sharing and Disclosure

Your privacy is paramount. We do not sell, rent, or trade your personal information to any thirdparties. Mitwa.ai is designed to work offline and does not upload your content. We will onlyshare your data in the following circumstances:
● Service Providers (Processors): We use a few trusted external service providers to helpus run the app, for example, services like Google/Apple/ Firebase for login, and theApple App Store for managing purchases. These providers only get the informationnecessary for their task.
● Third-Party Login Providers: If you choose to register or log in via Google Sign-In,Apple Sign-In/ Firebase, those platforms will inform you of the data they share with us.We only use that data to set up your Mitwa.ai account. Google and Apple act asindependent data controllers for the information they collect during authentication. Werecommend reviewing Google’s and Apple’s privacy policies for details on how theyhandle your login information. Mitwa.ai does not receive your Google or Apple accountpassword or any data from your profiles beyond the basic account info you consent toshare.
● Legal Requirements: We may disclose personal information if we are compelled by lawto do so, or if such action is necessary to comply with a legal obligation, to protect anddefend the rights or property of Mitwa.ai, to investigate fraud, or to protect the personalsafety of users or the public. We will only do this after careful review and as required orpermitted by applicable law.
● Business Transfers: In the event that Mitwa.ai is involved in a merger, acquisition,bankruptcy, or sale of assets, user information may be transferred to a successor oraffiliated entity as part of that transaction. If that happens, we will ensure the new ownerhonors the commitments that are under applicable privacy laws. You would also benotified of any change in data handling.
● No Third-Party Integrations: Mitwa.ai does not integrate with any external wellness orhealth platforms. We do not send any data to third-party wellness APIs or share yourprogress with any other service. Your personal journey in the app remains private andself-contained within Mitwa.ai.
● No Social Media Sharing: The App does not automatically share any data to socialnetworks. We do not disclose your information to advertisers or social media companies

5. Data Retention

We retain your personal data only for as long as necessary to fulfil the purposes described in thisPolicy, or as required by law, whichever is longer. Because we collect very minimal data, ourretention practices are straightforward:  
● Account Information: We retain your account details as long as your account remainsactive. If you choose to delete your account (see Your Rights below), we willpermanently delete your account information from the systems we control.
● Purchase Data: Apple maintains official transaction records for App Store purchases.We do not store payment method details. We may retain a minimal record of yourpurchase entitlement status (for example, whether the purchase is active) for as long asneeded to provide access and handle billing-related support or compliance obligations.
● Support Communications: If you contacted us, we may retain our correspondence for aperiod necessary to effectively address and follow up on your inquiry, and to improve ourcustomer service. These communications are typically retained for up to one year, unlessfurther retention is required for legal reasons.
● On-Device Data: All conversation and data is stored on your own device. Mitwa.ai doesnot have access to or control over that data. This means you control how long to keepyour conversations. If you wish to delete conversation history, you can do so by using thefeatures within the App. Since we never receive this data, we cannot recover it oncedeleted from your device.

6. Data Security

We take the security of your personal information very seriously. We use reasonable securitysteps to protect your information. Your chats and insights are saved only on your device and areprotected using device-level security measures with encryption. We don’t upload or store yourchat content on our servers. Login and purchase-related checks happen through trusted providersusing secure methods.
You should also take care to protect your own device and account credentials. We encourage youto use a strong password for your email (if that’s how you log in) and to keep your device lockedto prevent unauthorized access to the App.

7. Your Privacy Rights

Depending on where you live, you may have rights to access, correct, update, or delete certainaccount-related information we hold about you, and to withdraw consent where applicable.
Because your chats and insights are stored on your device and not uploaded to our servers, we donot have access to your conversation content. You can delete your on-device chat data by usingthe in-app delete options or by deleting the app.
To request changes or deletion of account-related information (such as your login identifier), orto raise a privacy grievance, contact us at support@mitwa.ai. We will respond within areasonable time and as required by applicable law.

8. Children’s Privacy

Mitwa.ai is intended for adults (18 years and older) and is not directed at children. We do notknowingly collect personal data from anyone under the age of 18. Users must affirm they are 18or older to create an account. If you are under 18, please do not use the App or provide anypersonal information. In the event we learn that we have inadvertently collected informationfrom a user under 18, we shall take prompt action in that case as we deem necessary

9. International Data Transfers

Mitwa.ai does not transfer your conversation content off your device. Purchases are processed byApple (App Store / In-App Purchase), and Apple may process related transaction data on serversin other countries under Apple’s privacy practices. Authentication providers may process accountidentifiers on servers located in other countries, depending on their infrastructure and yourregion

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices,technologies, legal requirements, or for other operational reasons. If we make material changes,we will notify you by updating the “Last Updated” date at the top of this Policy and, if required,by providing a prominent notice in the App. We encourage you to review this Policy periodicallyfor the latest information on our privacy practices. Any changes will become effective whenposted in the App (or on our website) along with the revised effective date. If you do not agree tothe changes, you should stop using the App and may request that we delete your account data.
